Earn-Your-Fee-Back Guarantee — Terms & Conditions
Effective date: August 17, 2025
Provider: WBNR (Arian Beyzaei) (“WBNR”, “we”, “us”)
Client: the customer purchasing the offer (“you”)
Layer 1: Performance Guarantee (Conditional)
If you achieve the Target below within the Guarantee Window, you are eligible for a refund of your Setup Fee (CAD $3,000), either as:
A credit against your next WBNR invoice (valid for 90 days), or
At our sole discretion, a cash refund to your original payment method (minus processor fees).
This is a performance guarantee, not a contest, sweepstakes, or lottery.
1. Eligibility
Applies only to new purchases of the stated program/offer made after the Effective Date.
One guarantee per legal entity/brand.
Non-transferable and not combinable with other promotions.
2. The Target & the Guarantee Window
Target: 5 Qualifying Booked Consults (see definition below).
Window: 21 consecutive days starting the next business day after your live webinar event (“Start”).
If your webinar date is delayed due to your actions, the Start date moves accordingly.
3. What Counts as a Qualifying Booked Consult
A booking must meet all of the following:
Booked on your official booking tool and appears on your calendar as a unique contact.
Written evidence of interest (email or SMS from the prospect) confirming desire to meet. Auto-replies and blank “yes” messages do not qualify.
Booked within the Guarantee Window (meeting may occur within 60 days after booking).
Minimum duration: 15 minutes.
Meeting type: sales or borrower consult (not support, billing, or internal).
Cancellations/no-shows: still count if validly booked during the Window.
Employees, contractors, vendors, bots, duplicates, or spam are excluded.
Existing customers are allowed (no net-new requirement).
4. Your Required Inputs (Before the Webinar)
To keep the guarantee valid, you must provide:
One of the following:
A list of ≥ 2,000 CASL-compliant opted-in contacts, OR
An advertising budget of ≥ CAD $1,500 for the 21-day period.
Brand assets and approvals.
Access to your booking tool.
A decision-maker who approves within 2 business days.
Agreement to send (or authorize us to send) the agreed invitations/reminders.
A stable and active booking link.
If these requirements are not met on time, we may delay the Start date day-for-day or void the guarantee.
5. What We Do
We:
Build the webinar and pages.
Send invitations and reminders.
Support and host the live session.
Provide weekly reports during the Guarantee Window.
6. Exclusions (When Guarantee Does Not Apply)
No guarantee if you:
Change offers, links, or audience without our approval.
Fail to send/approve communications on time.
Run conflicting promotions that siphon traffic.
Fabricate or coerce bookings.
7. Verification & Audit
You authorize us to view necessary calendar/CRM exports and campaign logs.
If you refuse verification, the guarantee is void.
WBNR’s determinations, acting reasonably and in good faith, are final.
Layer 2: Satisfaction Guarantee (Unconditional, Pre-Launch)
At 48 hours before your webinar go-live, you may review all campaign assets (slides, pages, emails).
If you are not satisfied, you may cancel and receive a full refund of the Setup Fee.
You keep all assets created up to that point.
Additional Legal Terms
8. Refund Method
Credits apply pre-tax and expire 90 days from issuance.
Cash refunds are at our discretion and processed net of payment processor fees.
Third-party spend (ads, SMS, software, platforms) is never refundable.
Chargebacks void eligibility.
9. Compliance
You represent that your email list is CASL-compliant and that you comply with all industry-specific rules (e.g., mortgage advertising, lender disclosures).
If a regulator or platform restricts outreach in a way that materially reduces reach, we may pause or void the guarantee.
10. Limits of Liability
Our total liability under this guarantee is capped at CAD $3,000 (the Setup Fee actually paid).
We are not liable for indirect, incidental, special, or consequential damages.
11. Modifications
We may modify or discontinue this guarantee prospectively at any time.
Changes do not affect Clients whose Guarantee Window has already started.
12. Governing Law & Disputes
Governed by Ontario law and applicable federal law of Canada.
Disputes resolved by binding arbitration in Toronto under the Arbitration Act, 1991 (Ontario).
No class actions; individual claims only.
13. Privacy & Data Use
We use your data and prospect data solely to deliver campaigns, verify results, and improve services.
We may use anonymized, aggregated metrics for case studies.
14. Entire Agreement
These Terms govern the guarantee mechanics.
Your service agreement/SOW governs scope and fees.
If conflicts exist, these Terms control the guarantee; the SOW controls service scope/fees.
15. Force Majeure
We are not liable for failures/delays beyond our reasonable control (platform outages, ISP issues, law changes, strikes, etc.).
